Bartlit Beck Prevails Again for Sikorsky Against DOJ

Bartlit Beck partners Jeff Hall and Kate Swift have prevailed for Sikorsky again in a government contract dispute against the Department of Justice.  The government sought $34 million for what it called an “alternative claim” to its earlier $80 million claim that Sikorsky's accounting practices violated cost accounting standards.  Bartlit Beck prevailed for Sikorsky at trial and in the Federal Circuit in that earlier action.  In August 2015, the Court of Federal Claims granted Sikorsky's motion for judgment on the alternative claim on claim preclusion grounds, rejecting the government's claim in its entirety.  The government appealed that judgment to the Federal Circuit, but in December 2015 it voluntarily dismissed its appeal, concluding the litigation in Sikorsky's favor.
