Abby M. Mollen

Abby Mollen is an accomplished trial lawyer and skilled legal strategist. Clients rely on Abby’s keen judgment and advocacy in their most complex and significant matters, describing her as “off the charts” in “skill level and smarts” (Legal 500 USA Guide 2025), their “first call” in the “most crucial matters” (BTI Client Service All Stars Report 2024), and a trusted advocate who “leaves no stone unturned” (Chambers USA Guide 2026).

Abby represents clients in a broad range of high-stakes business disputes before courts and arbitrators across the country. Her experience includes matters across various industries, including financial services, accounting, aerospace, cryptocurrency, healthcare, and the technology sector. In addition to defending companies in complex commercial disputes, Abby has significant experience representing investors as plaintiffs in financial litigation with billions of dollars at stake. Most notably, Abby served as trial counsel for several major institutional investors that collectively lost billions of dollars when the Structured Alpha hedge funds managed by Allianz Global Investors U.S. collapsed in 2020, in work recognized by the American Lawyer when those cases settled.

In addition to her courtroom work, Abby regularly advises clients in pre-litigation disputes, offering practical advice and assistance in achieving favorable out-of-court settlements

Outside of her practice at Bartlit Beck, Abby has served as a member of the law faculty at Northwestern University Pritzker School of Law, where she has taught courses on separation of powers, complex litigation, and the Supreme Court.

Among other recognitions, Abby is Chambers-ranked and an elected member of the American Law Institute. Abby graduated first in her class from Northwestern University Pritzker School of Law and joined Bartlit Beck following clerkships for Justice Sonia Sotomayor of the United States Supreme Court and Judge David S. Tatel of the United States Court of Appeals for the District of Columbia Circuit.

Confidential AAA Arbitration (St. Louis) 
Co-lead trial counsel for healthcare company in three-week AAA arbitration before a panel of three arbitrators, handling multiple direct and cross-examinations as well as closing arguments. The proceedings and outcome are confidential. 

Confidential AAA Arbitration (Seattle) 
Trial counsel for aerospace manufacturer in a two-week AAA arbitration before a panel of three arbitrators. The hearing involved opening statements, direct and cross-examinations, and closing arguments. The proceedings and outcome are confidential. 

Confidential AAA Arbitration (Minneapolis) 
Trial counsel for "Big Four" accounting firm in AAA arbitration. The claimant alleged accountants' negligence in advising on ESOP and other tax issues. Case settled favorably during trial after cross-examination of plaintiffs' witnesses. 

The FairPoint Communications, Inc. Litigation Trust v. Verizon Communications, Inc. (W.D.N.C.) 
Trial counsel for Verizon in $2 billion action brought by a litigation trust alleging that Verizon’s transfer of certain landline assets amounted to a fraudulent conveyance. Case settled following two-week bench trial. 

Tyco v. Swartz (S.D.N.Y.) 
Trial counsel for Tyco in case against former CFO for improperly received compensation in the Southern District of New York. Court ruled in Tyco’s favor after bench trial. 

Other Representative Cases

Allianz Structured Alpha Funds Litigation (S.D.N.Y.) 
Trial counsel for several major institutional investors who collectively lost billions of dollars when the Structured Alpha hedge funds managed by Allianz Global Investors U.S. collapsed in March 2020. Bartlit Beck also served as co-liaison counsel for a group of twenty plaintiffs for purposes of coordinating discovery with Allianz. The cases filed by our clients were settled on confidential terms. The Boeing Company v. Hamilton Sundstrand Corporation and Hamilton Sundstrand Space Systems International, Inc. (District Court, Harris County, TX) 
Represented the Defendants in this contract dispute relating to parts and systems supplied for the CST-100 Starliner space vehicle, which is designed to take astronauts to the International Space Station. Case settled. 

Verde Ventures v. Green Thumb Industries (Clark County, Nevada) 
Filed lawsuit on behalf of minority investor in limited liability company where majority member attempted to liquidate its interest in the LLC without affording our client its tag-along rights under the operating agreement. After fact and expert depositions and some motion practice, case settled. 

Spirit AeroSystems v. Boeing (Superior Court, King County, WA) 
Represented Spirit AeroSystems in $365 million breach of contract dispute with Boeing relating to Boeing's underpayments and certain warranty claims on parts Spirit manufactured for Boeing aircraft. Shortly after Spirit defeated Boeing's motion to dismiss, the parties settled. 

Dyson, Inc. v. BISSELL Homecare, Inc. (N.D. Ill.) 
Represented BISSELL in Lanham Act action brought by Dyson concerning vacuum cleaner advertisements. Case settled. 

Cloud Satchel v. Amazon.com (D. Del.) 
Trial and appellate counsel for Amazon.com in patent infringement case relating to document database and retrieval technology and the Kindle portable reader. Won summary judgment of invalidity. Affirmed by the Federal Circuit.  

UbiComm v. Zappos IP, Inc. (D. Del.) 
Trial counsel for Zappos in patent infringement case relating to e-mail reminder systems. Won judgment of invalidity under Section 101 on a Rule 12 motion. UbiComm chose not to pursue an appeal.
