U.S. Supreme Court Refuses to Review Judgment Won by Mark Levine, Chris Lind and Brian Swanson

The United States Supreme Court upheld a judgment won by Bartlit Beck partners Mark Levine, Chris Lind, and Brian Swanson for the Hamilton Sundstrand division of United Technologies Corporation.  The decision left in place Bartlit Beck's victory in defense of Hamilton Sundstrand in a patent infringement suit brought by Honeywell in the District of Delaware.  Bartlit Beck was brought in to try the case after a previous $46 million jury verdict against Hamilton Sundstrand was remanded for a new trial.  Upon hearing the evidence at trial, the court ruled that Honeywell was not entitled to the previous jury award because it was estopped from asserting the doctrine of equivalents based on the prosecution of its patents in the United States Patent and Trademark Office.  The Court of Appeals for the Federal Circuit affirmed the decision and the Supreme Court denied Honeywell's petition for certiorari.
