Adam Mortara Wins Chemical Process Patent Appeal For Bayer

Bartlit Beck partner Adam Mortara won an appeal for Bayer at the Federal Circuit arising from an interference proceeding.  The patent at issue claims a chemical process for making drospirenone, an active ingredient in Bayer's Yasmin®, YAZ® and Beyaz® products.  The Federal Circuit's decision terminates the interference in Bayer's favor, allowing it to maintain the patent on this production process.  The Arlington, Virginia law firm Millen, White, Zelano, & Branigan P.C. acted as co-counsel in the appeal, and as patent prosecution counsel in the PTO.  The case is Costantino v. Seilz, No. 2012-1511.
