Kat Hacker and Wins Patent Case for Amazon

Kat Hacker won a judgment of invalidity in a patent case brought against Amazon in the District of Delaware. The plaintiff, Device Enhancement, filed suit against Amazon in August of 2015. Shortly after, Amazon moved to dismiss the complaint on the grounds that the patent claims an unpatentable abstract idea under Section 101 and Alice Corp. v. CLS Bank International. While the motion was pending, the Federal Circuit issued Enfish, LLC v. Microsoft, only the second Federal Circuit case upholding a patent against a Section 101 challenge since Alice. In the first district court opinion addressing Enfish, the district court distinguished the case and concluded that the patent was indeed invalid.
