McCarthan v. FCI-Estill, Warden (Eleventh Circuit)
Appointed by the en banc Eleventh Circuit to brief and argue as special amicus curiae in a case addressing the scope of the savings clause, 28 U.S.C. § 2255(e), which permits a federal prisoner to petition for a writ of habeas corpus, in lieu of a motion to vacate the prisoner’s sentence. The Eleventh Circuit adopted the statutory interpretation advanced in the amicus brief.
