Bartlit Beck Defends Patent on Blockbuster Antibiotic Cipro

Bayer v. Carlsbad (2002)

Fred Bartlit and Mark Levine successfully defended Bayer's patent on the blockbuster drug "Cipro" against this "Hatch-Waxman" challenge to the patent's validity brought by a generic manufacturer, Carlsbad. After a twelve-day bench trial, Judge Brewster of the federal court in San Diego rejected the generic challenger's claim that the patented invention was obvious.
