After 20 Years, Don Scott Still Undefeated in Lead Paint Cases

07.2008

For 20 years, Don Scott has fought lead paint cases brought by states, cities, housing authorities, and individuals; he has settled none; and his team has won every case to reach a judgment.  Don's client, the former National Lead Company (now NL Industries), faced scores of lawsuits featuring highly emotional claims of child lead poisoning and brain damage.

Don has won dismissals and jury trials for NL across the country.  Don's most recent victory came in Rhode Island where the state Supreme Court in June 2008 reversed the only jury verdict ever against the lead pigment defendants and ordered the Attorney General's statewide public nuisance suit dismissed with prejudice.  State v. Lead Industries Ass'n, et al., No. 2007-121.
