Scott McBride and Cindy Sobel Win ANDA Trial For Bayer

Bartlit Beck partners Scott McBride and Cindy Sobel won a complete trial victory for Bayer in ANDA litigation over Bayer's oral contraceptive Natazia®.  Natazia® is the first-ever FDA approved combined oral contraceptive that uses estradiol valerate instead of the synthetic estrogen ethinylestradiol.  Defendant Watson Laboratories sought to market a generic version of Natazia® and challenged Bayer's patent covering Natazia®'s unique 28-day regimen.  After a bench trial, Chief Judge Leonard Stark of the District of Delaware yesterday issued a memorandum opinion and order finding that Watson had failed to show that Bayer's patent was invalid as obvious.
