Mark Levine, Mark Ouweleen and Sean Grimsley Win Patent Infringement Lawsuit for Sensormatic
Sensormatic's patents, on technology used in electronic article surveillance, were issued in 1998 and 2000. The Patent Office subsequently confirmed the validity of almost all of the claims in reexamination proceedings brought by Defendant Phenix.
Today, the Court found that Defendants Tag and Phenix infringed Sensormatic's patents and that the patents were valid and enforceable. The Court also found for Sensormatic on a claim for unfair competition, breach of contract, breach of fiduciary duty, and aiding and abetting breach of fiduciary duty.
Mark Levine and Mark Ouweleen led the Bartlit Beck team in the four-week bench trial. Sean Grimsley focused on the patent validity issues.
